HARDWARE MAINTENANCE CONTRACT
This Contract is only valid for equipment sited
within 25 miles of JLA's offices in Braintree, CM7 6QS. UK.
Cover provided under this contract (Software cover is available
under a separate contract)
- Twelve months on-site Maintenance, to cover
all replacement parts and labour charges, except those arising
from operator error or neglect.
- Response time, from time of notification to
this office, to time of arrival of technician at your premises:
eight (8) working hours,
- Cover to include replacement IBM compatible
machine if faulty unit has to be removed from premises, this replacement
to be affected prior to technician removing your equipment.
- An unlimited number of requests for service
during normal working hours of 9.00am to 5.00pm. , Monday to Friday
inclusive, excluding public and bank holidays. Work performed
outside normal working hours may be liable to charge.
- All labour, travelling time and travelling
expenses.
- The free and automatic replacement of all broken
or worn parts with the exception of software, stationary or storage
media, mice or keyboards. JLA may inspect, adjust, repair or replace
the equipment or any part of it as it considers necessary or advisable.
The service shall include repair of the equipment in JLA's workshops
if in the opinion of JLA such repair is necessary.
- JLA has no responsibility under this Contract
in relation to software, stationary or storage media.
- Additional Equipment purchased is not included.
Customer undertakes:
- To pay any additional charges.
- To carry out routine day to day preventative
maintenance as may be recommended under the Customer operating
instructions supplied with the equipment.
- To permit JLA service engineers to have full
access to the Equipment and proper facilities at the customers
premises, for the purpose of carrying out the Service to be provided
by JLA.
- To permit no alteration to apparatus or wiring
except by JLA or JLA's authorised servicing agents, and work to
be carried out in accordance with approved procedures.
- To notify JLA in writing in the event that the
Equipment is to be relocated in the territory fore mentioned overleaf.
Liabilities:
- JLA its servants and/or agents shall not be
liable for injury, losses or damage whatsoever unless it is caused
by the wilful default of JLA its servants and/or agents or in
the respect of death or injury unless it is caused by the negligence
of JLA its servants and/or agents. In any event JLA shall not
be liable for any losses damage or delay whatsoever arising from
any cause outside the control of JLA its servants and/or agents.
Acceptance:
- The Contract shall become accepted by and binding
on JLA only when signed on its behalf by an authorised signatory
of JLA.
Force Majure:
- Neither party shall be liable for any failure
to perform its obligations hereunder as such failure arises from
any act of God, War, Lockout or other labour dispute, Riot, Civil
Commotion, Fire, Flood, Drought, Legislation or other causes (whether
of the foregoing classes or not) beyond the control of the party
concerned.
This agreement shall be governed and interpreted
according to English Law.
